TCPA Consent
1. Consent for Telephone Communications
The Water Boys shall obtain prior express consent from individuals before making any telemarketing calls or sending text messages for promotional purposes. Consent must be freely given, specific, and informed.
2. National Do Not Call List (DNCL) Compliance
The Water Boys shall maintain and regularly update an internal Do Not Call List to ensure compliance with the National DNCL regulations. It shall refrain from making telemarketing calls to individuals who have registered their numbers on the DNCL.
3. Identification and Caller Display
The Water Boys shall ensure that the calling number and, if possible, the name of the organization are accurately displayed on the recipient's caller ID when making telemarketing calls.
4. Calling Hours Restriction
The Water Boys shall limit telemarketing calls to the hours specified by the Canadian Radio-television and Telecommunications Commission (CRTC). Calls shall not be made before 9:00 a.m. or after 9:30 p.m. local time.
5. Call Abandonment Prohibition
The Water Boys shall not engage in the practice of abandoning calls or making silent calls. It shall ensure that live operators are available to speak with recipients upon answering the call.
6. Record Keeping
The Water Boys shall maintain records of consent for a minimum of three years, including the time, date, and means through which consent was obtained. These records shall be made available to regulatory authorities upon request.
7. Training and Compliance
The Water Boys shall provide training to its employees engaged in telemarketing activities to ensure compliance with TCPA regulations. Employees shall be educated on the proper use of consent, DNCL compliance, and call abandonment prohibition.
8. Complaint Handling
The Water Boys shall establish a process to address and resolve customer complaints related to TCPA compliance promptly. Complaints shall be thoroughly investigated, and appropriate actions taken to rectify any issues.
9. Vendor Compliance
If The Water Boys engages third-party vendors for telemarketing activities, it shall ensure that they comply with TCPA regulations. Written agreements shall be in place with vendors to ensure adherence to all applicable laws.
10. Regulatory Updates
The Water Boys shall monitor and stay up-to-date with changes and amendments to TCPA regulations issued by the CRTC. Policies and procedures shall be updated accordingly to ensure ongoing compliance.
11. Internal Audits
The Water Boys shall conduct periodic internal audits to assess the effectiveness of its TCPA compliance program. The audits shall identify areas of improvement and address any non-compliance issues.
12. Marketing Preferences
The Water Boys shall provide an option for individuals to opt-out of receiving telemarketing calls and text messages. Marketing preferences shall be respected promptly upon request.
